Creator programme terms

1. Scope and contracting parties

These terms govern participation in the easysimy creator programme between Phoenix Immobilien Invest GmbH, Schützenstraße 8b, 32584 Löhne, Deutschland (operator of www.easysimy.com, “easysimy”) and the participant (“creator”).

The creator acts as an independent contractor. No employment, commercial agency or partnership relationship is created, and there is no obligation to be active to any particular extent.

2. Participation and approval

Participation requires an application through the creator portal and approval by easysimy. There is no entitlement to approval, and a rejection does not have to be justified.

The creator must provide truthful information and keep it up to date in the portal, in particular name, email address and bank details. Login details must be kept confidential.

Participation is open to persons aged 18 or over with full legal capacity.

3. Discount codes

easysimy sets up one or more personal discount codes for the creator. The type and size of the discount (for example a percentage or a “buy 2, get 1 free” promotion) is shown together with the applicable commission rate in the creator dashboard.

Codes are personal. They must not be sold, auctioned or handed to third parties for independent distribution, and may only be shared through channels the creator operates.

easysimy may change, pause or end codes at any time, in particular when a promotion expires or in cases of misuse. Commission already earned remains unaffected.

4. Commission

Orders are attributed solely through the discount code redeemed at checkout. There is no link or cookie tracking. If no code of the creator is redeemed, no commission arises.

The basis of calculation is the amount actually paid for the goods after all discounts, excluding shipping and other surcharges. The applicable rate is the one stored for the redeemed code at the time of the order; it is shown with every order in the dashboard.

Each code may carry its own commission rate. A change of rate applies to future orders only; orders already recorded keep their rate.

In the event of cancellation, withdrawal, refund or payment default, commission is reduced in proportion to the amount refunded, and lapses entirely on full reversal. Amounts already paid out are offset against future commission.

Orders placed by the creator themselves (identified by a matching email address) are recorded but do not earn commission.

No commission is owed for orders generated through the practices prohibited in section 6.

5. Payout

Commission is shown continuously in the dashboard as an open balance. Payouts are made by bank transfer to the account stored by the creator in the portal; without complete bank details no payout is possible.

Payouts are made on request by the creator, usually within 14 days of the request. There is no minimum payout amount. Every payout is documented in the dashboard.

Fees charged by the creator’s own bank and costs of international transfers are borne by the creator.

Objections to the amounts shown in the dashboard must be raised in text form to support@easysimy.com within eight weeks of the order being displayed.

6. Obligations when promoting

Promotional content must be clearly marked as advertising in line with applicable rules. Labelling is the creator’s responsibility.

The following are not permitted: misleading statements about product, price, coverage or speed; promotion on voucher, coupon and cashback sites; unsolicited emails, messages or comment spam; paid search ads on the “easysimy” brand or similar spellings (brand bidding); reselling the eSIM plans or offering the codes on marketplaces.

The creator is responsible for their own content and ensures that it infringes no third-party rights and no legal requirements.

easysimy may require individual content to be amended or removed if it breaches these terms or applicable law.

7. Brand and promotional material

For the duration of participation, easysimy grants the creator a simple, non-transferable and revocable right to use the logos, images and text snippets provided in order to promote easysimy.

Altering the material in a way that distorts its meaning, and any further use of the brand, are not permitted.

Content created by the creator remains theirs. The creator grants easysimy the simple right to share posts published under the programme on its own channels, with attribution.

8. Taxes

The creator is responsible for the taxation of their income, including any registration of their activity.

Commission rates are net amounts. If the creator is liable for VAT, statutory VAT is paid in addition and the creator must provide their VAT identification number. Where the German small business rule (§ 19 UStG) applies, no VAT is paid.

The creator confirms that this information is correct and reports any change without delay.

9. Term and termination

Participation runs for an indefinite period. Either side may end it at any time without notice in text form; a message to support@easysimy.com is sufficient.

In the event of a breach of these terms, easysimy may block access and codes immediately. Where fraud is established, in particular manipulated orders or orders placed through third parties for the creator’s own benefit, outstanding commission lapses.

After termination, undisputed commission from orders already recorded is paid out. The creator removes the codes from their content promptly.

10. Liability

easysimy does not owe any particular level of sales or commission and gives no warranty of uninterrupted availability of shop and portal.

easysimy is liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence liability is limited to the breach of material contractual duties and to foreseeable damage typical of this type of contract. Mandatory statutory liability remains unaffected.

11. Data protection

easysimy processes the creator’s data (contact details, channels, bank details, attributed orders) solely to run the programme and to settle commission. Bank details are used only for payouts.

Details are set out in the privacy policy at easysimy.com. Retention periods under commercial and tax law remain unaffected.

12. Changes to these terms

easysimy may amend these terms, for example when programme processes or legal requirements change. Changes are announced by email and in the portal.

The amended version must be confirmed at the next login. Anyone who does not agree may end their participation under section 9; claims arisen until then remain valid.

13. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the creator is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the registered office of easysimy.

Should any provision be invalid, the remaining provisions remain effective.
